Plain-language summary (not a substitute for the terms below): MorphPost is an AI tool provided "as is." You are responsible for what you create and publish with it. Our liability is limited to the maximum extent the law allows, and most disputes are resolved by binding arbitration on an individual basis. Some jurisdictions give you rights that these terms cannot remove — where that is the case, those rights still apply to you.

These Terms of Service ("Terms") are a binding agreement between you ("you," "user") and MorphPost, operated by Nexlite Agency ("MorphPost," "we," "us"). By creating an account, accessing, or using the MorphPost website, web application, or mobile applications (collectively, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. You use the Service at your own risk.

6A. Third-Party Services & Service Interruptions

The Service depends on third-party providers we do not control, including but not limited to our AI provider (the Anthropic Claude API), hosting and server infrastructure, payment processors, and email/SMS providers. We are not responsible or liable for any interruption, delay, degradation, downtime, data loss, or failure of the Service that is caused by, or arises from, any third-party provider, including outages, rate limits, suspensions, price or policy changes, maintenance, or discontinuation of their services. Any such interruption does not constitute a breach of these Terms by us, and does not entitle you to any refund except as required by applicable law or expressly provided by us. We will use commercially reasonable efforts to restore the Service but make no guarantee of availability.

You agree to indemnify and hold harmless MorphPost and Nexlite Agency from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your Input, your Output, your use of the Service, or your violation of these Terms or any law or third-party right.

9. Binding Arbitration & Class-Action Waiver

To the maximum extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court where eligible. You and MorphPost waive any right to a jury trial and to participate in a class, collective, or representative action. Arbitration will be conducted on an individual basis.

Where mandatory local law prohibits pre-dispute arbitration agreements or class-action waivers, those specific provisions will not apply to you to the extent prohibited, and the remainder of this section will still apply.

10. Governing Law & Venue

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-laws principles. Subject to Section 9, the courts located in Pakistan will have jurisdiction, except where applicable mandatory law entitles you to bring proceedings in your country of residence.

To the extent permitted by law, any claim relating to the Service must be filed within one (1) year after it arises, or it is permanently barred.

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full effect. Our failure to enforce any right is not a waiver of it.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that applicable law says cannot be excluded or limited. Where such laws apply, the relevant clauses above are read down to the extent necessary to comply, and no further.
